Patent Trolls & The Law

Markus Reitzig, Joachim Henkel and Christopher Heath argue that the rise of patent “trolls” or patent “sharks” has come about because of a deficiency in the law: courts don’t consider inadvertent infringement and opportunities to “invent around” when they calculate damages for infringement. A different policy would discourage wasteful litigation and encourage innovation.
